Principle 2: Exercise Oversight Responsibility
Attribute 2.02: The entity determines an oversight structure to fulfill responsibilities set forth by applicable laws and regulations, relevant government guidance, and feedback from key stakeholders. The entity will select, or if mandated by law will have selected for it by an applicable body, an oversight body. When the oversight body is composed of entity management, activities referenced in the Green Book as performed by "management" exclude these members of management when in their roles as the oversight body.

This is a subsection of the March 12, 2026 event, which is titled This is how Maricopa County chose to be represented in court.
Maricopa County's legal team explained that the Maricopa County Recorder's Office (MCRO) is a non-jural entity, meaning it is incapable of suing or being sued. Elsewhere in the Defense brief, the Maricopa County legal team repeatedly explained they are not required to create and retain documentation unless specifically stated as a statutory requirement. Hence, citizens are not entitled to oversee MCRO operations.
Potential Green Book Gap
Contrary to the Green Book, there does not appear to be any independent oversight of the MCRO, other than the elected official, which is commonly referred to as the Maricopa County Recorder. The Recorder cannot ethically provide independent oversight if the primary responsibility is for the overall operation of the office. I was unable to find an independent government entity responsible for oversight of the MCRO. The public cannot provide any oversight if there are minimal documents available for inspection. In my case, election-related documents are either confidential or non-existent. Voter registration information is not shared with the public and process steps are not documented or retained. The lack of oversight is a significant deviation from the Green Book. I have not been provided any information to suggest any independent oversight of the MCRO exists and the public doesn't have a means to review their performance for holding them accountable to its citizens.
